Enforcement Decree of the Restitution of Development Gains Act, Article 25-2 (Statement of Calculation of Development Costs)

① 법 제24조에 따라 개발비용의 산정에 필요한 명세서를 제출하려는 자는 다음 각 호에서 정하는 바에 따라 개발비용 산출명세서를 시장ㆍ군수ㆍ구청장에게 제출해야 한다. <개정 2013.3.23, 2020.9.8>

1. 국가 또는 지방자치단체로부터 개발사업의 준공인가 등을 받은 경우에는 부과 종료 시점부터 40일 이내에 제출할 것

2. 부과 대상 토지가 법 제9조제3항 단서에 해당되는 경우로서 준공된 개발사업별로 개발비용을 산출하기 곤란한 경우에는 전체 개발사업이 완료된 날부터 40일 이내에 명세서를 제출할 것. 이 경우 부과 종료 시점이 서로 다른 대상 토지는 그 명세서를 별도로 구분하여 작성하여야 한다.

② 제1항에 따른 개발비용 산출명세서에는 설계서 등 개발비용 산출 증명서류를 첨부하여야 한다. 다만, 법 제11조제2항에 따라 국토교통부장관이 고시하는 단위면적당 표준비용을 적용하는 경우에는 제12조제1항제1호부터 제4호까지의 개발비용에 대한 개발비용 산출 증명서류는 첨부하지 아니한다. <개정 2011.11.11, 2013.3.23>
