건설산업기본법 제48조(건설사업자 간의 상생협력 등)

① 국토교통부장관은 건설업의 균형 있는 발전과 건설공사의 효율적인 수행을 위하여 종합공사를 시공하는 업종을 등록한 건설사업자와 전문공사를 시공하는 업종을 등록한 건설사업자 간의 상생협력 관계 및 대기업인 건설사업자와 중소기업인 건설사업자 간의 상생협력 관계를 유지ㆍ발전하도록 하도급, 공동도급 등에 관한 지도를 할 수 있다. <개정 2013.3.23, 2019.4.30>

② 국토교통부장관은 건설사업자 간의 상생협력 관계를 유지하도록 하기 위하여 종합공사를 시공하는 업종을 등록한 건설사업자로 하여금 시공할 공사와 관련이 있는 업종의 건설사업자를 협력업자로 등록받도록 지도할 수 있다. <개정 2013.3.23, 2019.4.30>

③ 제2항에 따라 등록을 받은 건설사업자와 등록한 협력업자는 다음 각 호의 사항에 관하여 상생협력하여야 한다. <개정 2019.4.30>

④ 국토교통부장관은 제1항과 제2항에 따른 지도를 이행한 실적이나 협력업자와의 협력 관계를 평가하여 그 실적이 우수한 종합공사를 시공하는 업종을 등록한 건설사업자를 시공능력 평가나 공사 발주 시 우대하도록 관계 기관에 협조를 요청할 수 있다. <개정 2013.3.23, 2019.4.30>

⑤ 제1항에 따른 지도, 제2항에 따른 협력업자의 등록 및 건설업체 간의 협력에 필요한 사항은 대통령령으로 정한다.
