건설폐기물의 재활용촉진에 관한 법률 시행령 제9조(건설폐기물의 처리기준 등)

1. 건설폐기물은 폐콘크리트ㆍ폐아스팔트콘크리트ㆍ폐목재ㆍ폐합성수지ㆍ폐금속류 등의 종류별로 재활용가능성, 소각가능성 또는 매립필요성 여부 등에 따라 구분하여 배출, 수집ㆍ운반, 보관할 것. 다만, 다음 각 목의 어느 하나에 해당하는 경우에는 그러하지 아니하다.

1. 1의2. 건설폐기물을 중간처리한 후 발생되는 폐기물(별표 1 제10호 및 제16호에 따른 건설오니 및 건설폐토석은 제외한다)은 「폐기물관리법」 제17조 및 제18조에 따라 처리할 것. 다만, 건설폐기물 처리시설에서 발생되는 폐기물 중 그 성질과 상태가 중간처리하기 전의 폐기물과 동일한 폐기물은 법 제2조제5호에 따른 중간처리업자(이하 "중간처리업자"라 한다)가 자기소유의 건설폐기물 수집ㆍ운반차량으로 수집ㆍ운반할 수 있다.

2. 건설폐기물을 수집ㆍ운반하는 자는 건설폐기물을 수집ㆍ운반하는 차량(철도차량 및 선박을 포함한다)에 건설폐기물을 수집ㆍ운반하는 차량임을 표시하고, 건설폐기물수집ㆍ운반증을 부착(철도차량 또는 선박으로 운반하는 경우에는 휴대)할 것. 다만, 다음 각목의 어느 하나에 해당되는 경우에는 그러하지 아니하다.

10. 건설폐기물을 중간처리하는 자는 위탁받은 건설폐기물과 중간처리한 후 발생한 폐기물을 보관하는 시설을 설치하여 재활용대상, 소각대상 및 매립대상으로 각각 보관하여 처리하되, 보관시설에는 보관표지판을 설치할 것
