건축물관리법 시행령 제38조(건축물관리점검 평가위원회)

① 법 제50조제3항에 따른 건축물관리점검 평가위원회(이하 "평가위원회"라 한다)는 위원장 및 부위원장 각 1명을 포함한 300명 이내의 위원으로 성별을 고려하여 구성한다.

(1) The^ð더 Building빌딩 Management매너지먼트 Inspection인스펙션 Evaluation이^v밸류에이션 Committee커미티 under언더 Article아터클 50 (3) of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð디 "Evaluation이^v밸류에이션 Committee")커미티 shall섈 be비 composed컴포우즈드 of어^v브 no노우 more모 than^ð댄 300 members,멤버즈 including인클루딩 one원 chairperson체어퍼슨 and앤드 one원 vice^v바이스 chairperson,체어퍼슨 in인 consideration컨시더^r레이션 of어^v브 gender.젠더

② 실시결과평가기관의 장은 평가위원회의 위원을 다음 각 호의 어느 하나에 해당하는 사람 중에서 국토교통부장관의 승인을 받아 위촉하며, 위원장 및 부위원장을 위원 중에서 위촉한다.

③ 평가위원회의 위원장, 부위원장 및 위원 중 공무원이 아닌 사람의 임기는 2년으로 하며, 한 차례만 연임할 수 있다.

④ 평가위원회의 회의는 위원장과 위원장이 회의 시마다 지정하는 위원을 포함하여 총 3명 이상 7명 이하로 구성한다.

(4) Meetings미팅즈 of어^v브 the^ð디 Evaluation이^v밸류에이션 Committee커미티 shall섈 be비 composed컴포우즈드 of어^v브 at앳 least리스트 three^θ쓰^r리 and앤드 no노우 more모 than^ð댄 seven세^v븐 members멤버즈 in인 total,토우틀 including인클루딩 the^ð더 chairperson체어퍼슨 and앤드 members멤버즈 designated데지그네이티드 by바이 the^ð더 chairperson체어퍼슨 for^f포 each이치 meeting.미팅

⑤ 평가위원회는 제4항에 따른 구성원 과반수의 출석으로 개의(開議)하고, 출석위원 과반수의 찬성으로 의결한다.

(5) The^ð디 Evaluation이^v밸류에이션 Committee커미티 shall섈 open오우픈 its잇츠 meetings미팅즈 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 under언더 paragraph패^r러그^r래^f프 (4) and앤드 adopt어답트 resolutions^r레절루션즈 with위^ð드 the^ð더 concurring컨커^r링 votes^v보우츠 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 present.프^r레전트

⑥ 평가위원회 위원의 제척ㆍ기피ㆍ회피 및 해촉에 관하여는 제34조를 준용한다. 이 경우 "중앙건축물사고조사위원회"는 "평가위원회"로, "조사위원"은 "평가위원회의 위원"으로, "국토교통부장관"은 "실시결과평가기관의 장"으로 본다.

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 평가위원회의 구성ㆍ운영 등에 관한 세부 사항은 실시결과평가기관의 장이 국토교통부장관의 승인을 받아 정한다.
