골재채취법 시행령 제28조(골재채취허가의 우선순위)

①시장ㆍ군수 또는 구청장[「배타적 경제수역법」 제2조에 따른 배타적 경제수역(이하 "배타적 경제수역"이라 한다)에서의 골재채취의 경우에는 국토교통부장관을 말하며, 법 제34조에 따른 골재채취단지(배타적 경제수역에서 지정된 골재채취단지는 제외한다)에서의 골재채취의 경우에는 시ㆍ도지사를 말한다. 이하 제30조에서 같다]은 동일한 구역에 2이상의 골재채취의 허가신청이 있는 경우에는 법 제22조제4항의 규정에 의하여 다음 각호의 순위에 따라 골재채취를 허가하여야 한다. <개정 2012.8.22, 2013.3.23>

②제1항제4호의 경우로서 동일순위에 해당하는 골재채취의 허가신청인이 2인이상인 경우에는 법 제22조의3에 따른 골재채취 능력의 평가결과에 따라 배분하여 허가하여야 한다. 다만, 골재를 채취하려는 구역이 법 제34조제1항제4호에 따른 공동체의 신청에 따라 지정된 골재채취단지로서 해당 구역에 대하여 처음으로 골재채취를 허가하는 경우에는 해당 공동체에 속한 골재채취업자를 다른 자보다 우선하여 허가할 수 있다. <개정 2003.6.30, 2005.6.30, 2012.8.22, 2018.9.28>
