Enforcement Decree of the Public Property and Commodities Management Act, Article 11 (Restrictions on Disposal, etc.)
법 제19조제1항제1호에 따라 행정재산의 용도와 성질을 유지하는 조건으로 국가 또는 다른 지방자치단체에 양여하는 경우는 다음 각 호의 어느 하나에 해당하는 경우로 한다. <개정 2010.8.4, 2014.7.14, 2015.7.20>
Cases of granting administrative property to the State or another local government on the condition of maintaining its use and nature pursuant to Article 19 (1) 1 of the Act are as follows:
1. 다른 법령에 따라 해당 지방자치단체의 사무가 국가나 다른 지방자치단체로 이관(移管)됨에 따라 행정재산의 소유권이 변동되는 경우
1. Where ownership of administrative property changes because the affairs of the relevant local government are transferred to the State or another local government under other laws and regulations;
2. 기존 도로의 확장ㆍ축소로 인하여 「도로법」 제23조에 따른 도로 관리청 또는 「국토의 계획 및 이용에 관한 법률」 제43조제3항에 따라 해당 지방자치단체의 조례로 정하는 관리청이 지방자치단체 간에 변경되는 경우
2. Where the road management authority under Article 23 of the Road Act, or the management authority prescribed by ordinance of the relevant local government under Article 43 (3) of the National Land Planning and Utilization Act, changes between local governments due to the extension or reduction of an existing road;
3. 「공유수면 관리 및 매립에 관한 법률」 제35조제1항에 따라 협의하거나 승인을 받은 지방자치단체가 같은 조 제2항 단서에 따라 다른 지방자치단체에 공유수면 매립에 관한 권리를 양도하는 경우
3. Where a local government that has consulted or obtained approval under Article 35 (1) of the Public Waters Management and Reclamation Act transfers rights concerning reclamation of public waters to another local government pursuant to the proviso to paragraph (2) of the same Article.
