공익법인의 설립ㆍ운영에 관한 법률 시행령 제16조(재산의 구분)
Enforcement Decree of the Act on the Establishment and Operation of Public-Interest Corporations, Article 16 (Classification of Property)
①공익법인의 재산중 다음 각호의 1에 해당하는 재산은 기본재산으로 한다.
(1) Of the property of a public-interest corporation, property falling under any of the following shall be basic property:
1. 설립시 기본재산으로 출연한 재산
1. Property contributed as basic property at the time of establishment;
2. 기부에 의하거나 기타 무상으로 취득한 재산. 다만, 기부목적에 비추어 기본재산으로 하기 곤란하여 주무관청의 승인을 얻은 것은 예외로 한다.
2. Property acquired by donation or otherwise acquired free of charge: Provided, That property which is difficult to treat as basic property in light of the purpose of the donation and for which approval of the competent authority has been obtained is excepted;
3. 보통재산중 총회 또는 이사회에서 기본재산으로 편입할 것을 의결한 재산
3. Property of the ordinary property that the general meeting or board of directors has resolved to incorporate into basic property;
4. 세계잉여금중 적립금
4. Reserves out of the carry-over surplus of the national treasury.
②보통재산은 기본재산 이외의 모든 재산으로 한다.
(2) Ordinary property means all property other than basic property.
③주무관청은 공익법인의 보통재산이 과다하다고 인정할 때에는 그 일부를 기본재산으로 편입하게 할 수 있다.
(3) Where the competent authority deems the ordinary property of a public-interest corporation excessive, it may have part of it incorporated into basic property.
