공직선거법 제196조(선거의 연기)

①천재ㆍ지변 기타 부득이한 사유로 인하여 선거를 실시할 수 없거나 실시하지 못한 때에는 대통령선거와 국회의원선거에 있어서는 대통령이, 지방의회의원 및 지방자치단체의 장의 선거에 있어서는 관할선거구선거관리위원회위원장이 당해 지방자치단체의 장(직무대행자를 포함한다)과 협의하여 선거를 연기하여야 한다. <개정 2000.2.16>

②제1항의 경우 선거를 연기한 때에는 처음부터 선거절차를 다시 진행하여야 하고, 선거일만을 다시 정한 때에는 이미 진행된 선거절차에 이어 계속하여야 한다.

③제1항의 규정에 의하여 선거를 연기하는 때에는 대통령 또는 관할선거구선거관리위원회위원장은 연기할 선거명과 연기사유 등을 공고하고, 지체없이 대통령은 관할선거구선거관리위원회위원장에게, 관할선거구선거관리위원회위원장은 당해 지방자치단체의 장에게 각각 통보하여야 한다. <개정 2000.2.16>
