관세법 제211조(잔금처리)

① 세관장은 제210조에 따른 매각대금을 그 매각비용, 관세, 각종 세금의 순으로 충당하고, 잔금이 있을 때에는 이를 화주에게 교부한다.

② 제208조에 따라 매각하는 물품의 질권자나 유치권자는 해당 물품을 매각한 날부터 1개월 이내에 그 권리를 증명하는 서류를 세관장에게 제출하여야 한다.

③ 세관장은 제208조에 따라 매각된 물품의 질권자나 유치권자가 있을 때에는 그 잔금을 화주에게 교부하기 전에 그 질권이나 유치권에 의하여 담보된 채권의 금액을 질권자나 유치권자에게 교부한다.

④ 제3항에 따라 질권자나 유치권자에게 공매대금의 잔금을 교부하는 경우 그 잔금액이 질권이나 유치권에 의하여 담보된 채권액보다 적고 교부받을 권리자가 2인 이상인 경우에는 세관장은 「민법」이나 그 밖의 법령에 따라 배분할 순위와 금액을 정하여 배분하여야 한다.

⑤ 제1항에 따른 잔금의 교부는 관세청장이 정하는 바에 따라 일시 보류할 수 있다.

⑥ 제208조제4항에 따라 매각대행기관이 매각을 대행하는 경우에는 매각대행기관이 제1항부터 제5항까지의 규정에 따라 매각대금의 잔금처리를 대행할 수 있다.
