광산피해의 방지 및 복구에 관한 법률 시행령 제22조(광해방지사업의 진행에 따른 사업비의 지급절차)

①법 제18조제1항에 따른 사업비는 법 제15조에 따른 등록취소, 영업정지의 처분 또는 법 제17조제4항에 따른 중지명령의 원인행위가 발생하기 전까지 기성검사를 마친 공사에 든 사업비를 기준으로 하여 지급한다. 다만, 천재지변 등으로 기성검사 전에 시공된 공사시설물 등이 소실된 경우에는 산업통상부장관이 기성검사를 마친 공사로 인정하는 분에 든 사업비를 포함한다. <개정 2008.2.29, 2013.3.23, 2015.9.25, 2025.10.1>

②산업통상부장관은 법 제18조제1항에 따른 사업비의 지급을 신청 받은 때에는 신청 받은 날부터 7일 이내에 사업비를 지급하여야 한다. 다만, 제1항 단서의 경우에는 산업통상부장관이 이미 실시된 사업의 진행정도 및 전체사업에 대한 기여도를 확인하기 위하여 현장확인을 하는 기간은 산입하지 아니 한다. <개정 2008.2.29, 2013.3.23, 2025.10.1>
