교과용 도서에 관한 규정 제10조의2(이의신청)

① 제9조제3항에 따른 본심사 결과 불합격 결정을 받은 경우 교육부장관은 그 사유를 정확하게 적어 검정신청을 한 자에게 통지하여야 하고, 불합격 통지를 받은 자는 통지받은 날부터 1개월 이내에 교육부장관에게 별지 제1호서식에 따라 이의신청을 할 수 있다. <개정 2013.3.23, 2014.2.18>

② 교육부장관은 제1항에 따른 이의신청에 대하여 그 타당성 여부를 심사하고 접수한 날부터 60일 이내에 그 결과를 통지하여야 한다. <개정 2013.3.23>

③ 교육부장관은 이의신청에 대한 심사 결과 이를 받아들이지 아니하는 결정을 한 때에는 신청인에게 그 결정 또는 제1항에 따른 불합격 결정에 대하여 행정심판 또는 행정소송을 제기할 수 있다는 취지를 제2항에 따른 결과통지와 함께 통지하여야 한다. <개정 2013.3.23>
