국가인권위원회법 제45조(고발 및 징계권고)

① 위원회는 진정을 조사한 결과 진정의 내용이 범죄행위에 해당하고 이에 대하여 형사 처벌이 필요하다고 인정하면 중대범죄수사청장에게 그 내용을 고발할 수 있다. 다만, 피고발인이 군인등인 경우에는 소속 군 참모총장 또는 국방부장관에게 고발할 수 있다. <개정 2022.1.4, 2026.8.4>

② 위원회가 진정을 조사한 결과 인권침해 및 차별행위가 있다고 인정하면 피진정인 또는 인권침해에 책임이 있는 사람을 징계할 것을 소속기관등의 장에게 권고할 수 있다.

③ 제1항에 따라 고발을 받은 중대범죄수사청장, 군 참모총장 또는 국방부장관은 고발을 받은 날부터 3개월 이내에 수사를 마치고 그 결과를 위원회에 통지하여야 한다. 다만, 3개월 이내에 수사를 마치지 못할 때에는 그 사유를 밝혀야 한다. <개정 2026.8.4>

④ 제2항에 따라 위원회로부터 권고를 받은 소속기관등의 장은 권고를 존중하여야 하며 그 결과를 위원회에 통지하여야 한다.
