국민건강보험법 제45조(요양급여비용의 산정 등)

① 요양급여비용은 공단의 이사장과 대통령령으로 정하는 의약계를 대표하는 사람들의 계약으로 정한다. 이 경우 계약기간은 1년으로 한다.

② 제1항에 따라 계약이 체결되면 그 계약은 공단과 각 요양기관 사이에 체결된 것으로 본다.

③ 제1항에 따른 계약은 그 직전 계약기간 만료일이 속하는 연도의 5월 31일까지 체결하여야 하며, 그 기한까지 계약이 체결되지 아니하는 경우 보건복지부장관이 그 직전 계약기간 만료일이 속하는 연도의 6월 30일까지 심의위원회의 의결을 거쳐 요양급여비용을 정한다. 이 경우 보건복지부장관이 정하는 요양급여비용은 제1항 및 제2항에 따라 계약으로 정한 요양급여비용으로 본다. <개정 2013.5.22>

④ 제1항 또는 제3항에 따라 요양급여비용이 정해지면 보건복지부장관은 그 요양급여비용의 명세를 지체 없이 고시하여야 한다.

⑤ 공단의 이사장은 제33조에 따른 재정운영위원회의 심의ㆍ의결을 거쳐 제1항에 따른 계약을 체결하여야 한다.

(5) The^ð더 President프^r레저덴트 of어^v브 the^ð더 Service서^v비스 shall섈 conclude컨클루드 the^ð더 contract칸트^r랙트 under언더 paragraph패^r러그^r래^f프 (1) after애^f프터 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 by바이 the^ð더 Finance^f퍼낸스 Management매너지먼트 Committee커미티 under언더 Article아터클 33.

⑥ 심사평가원은 공단의 이사장이 제1항에 따른 계약을 체결하기 위하여 필요한 자료를 요청하면 그 요청에 성실히 따라야 한다.

(6) When웬 the^ð더 President프^r레저덴트 of어^v브 the^ð더 Service서^v비스 requests^r리퀘스츠 materials머티^r리얼즈 necessary네서세^r리 for^f포 concluding컨클루딩 the^ð더 contract칸트^r랙트 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 Review^r리^v뷰 and앤드 Assessment어세스먼트 Service서^v비스 shall섈 faithfully^f페이^θ스^f펄리 comply컴플라이 with위^ð드 the^ð더 request.^r리퀘스트

⑦ 제1항에 따른 계약의 내용과 그 밖에 필요한 사항은 대통령령으로 정한다.

(7) The^ð더 contents칸텐츠 of어^v브 the^ð더 contract칸트^r랙트 under언더 paragraph패^r러그^r래^f프 (1) and앤드 other어^ð더 necessary네서세^r리 matters매터즈 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리
