국민기초생활 보장법 제6조의3(소득인정액의 산정)

① 제2조제9호에 따른 개별가구의 소득평가액은 개별가구의 실제소득에도 불구하고 보장기관이 급여의 결정 및 실시 등에 사용하기 위하여 산출한 금액으로 다음 각 호의 소득을 합한 개별가구의 실제소득에서 장애ㆍ질병ㆍ양육 등 가구 특성에 따른 지출요인, 근로를 유인하기 위한 요인, 그 밖에 추가적인 지출요인에 해당하는 금액을 감하여 산정한다.

② 제2조제9호에 따른 재산의 소득환산액은 개별가구의 재산가액에서 기본재산액(기초생활의 유지에 필요하다고 보건복지부장관이 정하여 고시하는 재산액을 말한다) 및 부채를 공제한 금액에 소득환산율을 곱하여 산정한다. 이 경우 소득으로 환산하는 재산의 범위는 다음 각 호와 같다.

③ 실제소득, 소득평가액 및 재산의 소득환산액의 산정을 위한 구체적인 범위ㆍ기준 등은 대통령령으로 정한다.
