국민투표법 제119조(국민투표범죄신고자에 대한 포상금 지급)

① 각급 선거관리위원회(읍ㆍ면ㆍ동선거관리위원회를 제외한다. 이하 이 조에서 같다)는 국민투표범죄에 대하여 선거관리위원회가 인지하기 전에 그 범죄행위의 신고를 한 사람에게 포상금을 지급할 수 있다.

② 중앙선거관리위원회 및 시ㆍ도선거관리위원회는 제1항에 따른 포상금 지급의 심사를 위하여 중앙선거관리위원회규칙으로 정하는 바에 따라 각각 포상금심사위원회를 설치ㆍ운영하여야 한다.

③ 각급 선거관리위원회는 제1항에 따라 포상금을 지급한 후 다음 각 호의 어느 하나에 해당하는 사유가 있는 경우에는 그 포상금의 지급결정을 취소한다. 다만, 제2호의 경우 법원의 판결에 따라 유죄로 확정된 경우는 제외한다.

④ 각급 선거관리위원회는 제3항에 따라 포상금의 지급결정을 취소한 때에는 해당 신고자에게 그 취소 사실과 지급받은 포상금에 해당하는 금액을 반환할 것을 통지하여야 하며, 해당 신고자는 통지를 받은 날부터 30일 이내에 그 금액을 해당 선거관리위원회에 납부하여야 한다.

⑤ 각급 선거관리위원회는 제4항에 따라 포상금의 반환을 통지받은 해당 신고자가 납부기한까지 반환할 금액을 납부하지 아니한 때에는 해당 신고자의 주소지를 관할하는 세무서장에게 징수를 위탁하고 관할 세무서장이 국세 강제징수의 예에 따라 징수한다.

⑥ 제4항 또는 제5항에 따라 납부 또는 징수된 금액은 국가에 귀속된다.

⑦ 포상금의 지급 기준 및 절차, 포상금심사위원회의 구성 및 심의사항, 제3항제2호 및 제3호의 경우 포상금의 반환사유, 반환금액의 납부절차, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다.
