국세징수법 제82조(입찰서 제출과 개찰)

① 공매를 입찰의 방법으로 하는 경우 공매재산의 매수신청인은 그 성명ㆍ주소ㆍ거소, 매수하려는 재산의 명칭, 매수신청가격, 공매보증, 그 밖에 필요한 사항을 입찰서에 적어 개찰이 시작되기 전에 공매를 집행하는 공무원에게 제출하여야 한다.

② 개찰은 공매를 집행하는 공무원이 공개적으로 각각 적힌 매수신청가격을 불러 입찰조서에 기록하는 방법으로 한다.

③ 공매를 집행하는 공무원은 최고가 매수신청인을 정한다. 이 경우 최고가 매수신청가격이 둘 이상이면 즉시 추첨으로 최고가 매수신청인을 정한다.

④ 공매를 집행하는 공무원은 제3항 후단을 적용할 때 해당 매수신청인 중 출석하지 아니한 자 또는 추첨을 하지 아니한 자가 있는 경우 입찰 사무와 관계없는 공무원으로 하여금 대신하여 추첨하게 할 수 있다.

⑤ 공매를 집행하는 공무원은 공매예정가격 이상으로 매수신청한 자가 없는 경우 즉시 그 장소에서 재입찰을 실시할 수 있다.
