국제조세조정에 관한 법률 시행령 제8조(거래순이익률방법)

Enforcement Decree of the Adjustment of International Taxes Act, Article 8 (Transactional Net Margin Method)

① 법 제8조제1항제4호에 따른 거래순이익률방법을 적용할 때 거주자와 특수관계가 없는 자 간의 거래에서 실현된 통상의 거래순이익률은 다음 각 호의 어느 하나에 해당하는 지표를 기초로 산출한다.

② 제1항에 따른 거주자와 특수관계가 없는 자 간의 거래에서 실현된 통상의 거래순이익률을 산출할 수 없는 경우에는 다음 각 호의 거래 중 해당 거래와 수행된 기능, 사용된 자산 및 부담한 위험의 정도가 유사한 거래에서 발생한 통상의 거래순이익률을 제1항에 따른 통상의 거래순이익률로 사용할 수 있다.
