군사기지 및 군사시설 보호법 시행령 제20조(매수가격의 산정시기ㆍ방법 및 매수청구 절차)

① 법 제17조제1항에 따라 토지의 매수를 청구하려는 자는 국방부령으로 정하는 서류를 국방부장관 또는 관할부대장등에게 제출하여야 한다. 이 경우 관할부대장등이 접수한 서류는 지체 없이 국방부장관에게 제출하여야 한다.

② 제1항에 따라 매수청구를 받은 국방부장관은 해당 토지가 제19조에 따른 매수대상토지의 범위 및 판정기준에 해당되는지의 여부를 판단하여 매수청구를 받은 날부터 1년 이내에 매수대상 여부 및 매수예상가격 등을 매수청구인에게 직접 또는 관할부대장등을 거쳐 통보하여야 한다.

③ 제2항에 따른 매수예상가격은 매수청구 당시의 개별공시지가로 한다.

④ 국방부장관은 제2항에 따라 매수청구인에게 매수대상토지에 해당된다고 통보를 한 때에는 5년 이내에 매수계획을 수립하여 그 토지를 매수하여야 한다.

⑤ 국방부장관은 제4항의 매수계획에 따라 매수대상토지를 매수하려는 때에는 「감정평가 및 감정평가사에 관한 법률」에 따른 감정평가법인등 2인 이상에게 대상토지에 대한 감정평가를 의뢰하여 매수가격을 결정하고, 이를 매수청구인에게 통보하여야 한다. 이 경우 국방부장관은 감정평가를 의뢰하기 30일 전까지 매수청구인에게 감정평가를 의뢰한다는 사실을 통보하여야 한다. <개정 2016.8.31, 2022.1.21>

⑥ 제5항에 따른 매수가격은 매수청구 당시의 표준지공시지가(「부동산 가격공시에 관한 법률」 제3조에 따른 표준지공시지가를 말한다. 이하 같다)를 기준으로 그 공시기준일부터 매수청구인에게 지급하려는 날까지의 기간 동안 다음 각 호의 변동사항을 고려하여 감정평가법인등 2인 이상이 평가한 금액의 산술평균치로 한다. <개정 2013.3.23, 2016.8.31, 2022.1.21, 2024.7.9>

⑦ 제6항에 따른 감정평가법인등의 평가액 중 최고평가액이 최저평가액의 110퍼센트를 넘는 경우에는 국방부장관은 다른 2인 이상의 감정평가법인등에게 평가를 다시 의뢰할 수 있다. <개정 2022.1.21>

⑧ 국방부장관은 제4항에 따른 매수계획을 수립한 경우 필요하다고 판단하는 때에는 매수대상토지가 있는 보호구역등의 관할부대장등에게 제5항부터 제7항까지의 매수업무를 하게 할 수 있다. 이 경우 국방부장관은 매수청구자에게 그 사실을 지체 없이 통보하여야 한다.
