군인연금법 제5조(복무기간의 계산)

① 군인의 복무기간은 그 임용된 날이 속하는 달부터 퇴직한 날의 전날 또는 사망한 날이 속하는 달까지의 연월수(年月數)로 계산한다.

② 장교에서 부사관 또는 준사관으로 임용된 사람, 부사관(지원에 의하지 아니하고 임용된 부사관은 제외한다)에서 준사관 또는 장교로 임용된 사람 및 준사관에서 부사관 또는 장교로 임용된 사람의 복무기간은 상호 합산하되, 장교, 준사관 또는 부사관(지원에 의하지 아니하고 임용된 부사관은 제외한다)으로 복무 중에 군간부후보생에 지원한 경우에는 군간부후보생 기간을 포함한다. <개정 2026.6.9>

③ 전투에 참가한 기간은 3배로 계산한다.

(3) The^ð더 period피^r리어드 of어^v브 participation파티서페이션 in인 combat캄뱃 shall섈 be비 calculated캘큘레이티드 as애즈 three^θ쓰^r리 times.타임즈

④ 이 법의 적용을 받는 군인으로 임용되기 전의 「병역법」에 따른 현역병 또는 지원에 의하지 아니하고 임용된 부사관의 복무기간(방위소집ㆍ상근예비역소집 또는 보충역소집에 따라 복무한 기간 중 대통령령으로 정하는 복무기간을 포함한다)은 본인이 원하는 바에 따라 제1항의 복무기간에 산입(算入)할 수 있다. 이 경우 복무기간을 산입하려는 사람은 복무기간 산입신청서를 국방부장관에게 제출하여야 한다.

⑤ 퇴직한 군인ㆍ공무원 또는 사립학교교직원(이 법, 「공무원연금법」 또는 「사립학교교직원 연금법」의 적용을 받지 아니하였던 사람은 제외한다)이 군인으로 복무하게 된 경우에는 본인이 원하는 바에 따라 종전의 해당 연금법에 따른 복무기간 또는 재직기간을 제1항의 복무기간에 합산할 수 있다.

⑥ 복무기간을 계산할 때 19년 6개월 이상 20년 미만으로 복무한 사람의 복무기간은 20년으로 한다.

(6) In인 calculating캘큘레이팅 the^ð더 service서^v비스 period,피^r리어드 the^ð더 service서^v비스 period피^r리어드 of어^v브 a어 person퍼슨 who후 served서^v브드 19 years이어즈 and앤드 6 months먼^θ쓰 or오 more모 but벗 less레스 than^ð댄 20 years이어즈 shall섈 be비 20 years.이어즈

⑦ 복무기간의 계산은 정부수립연도 이전으로 소급하지 못한다.

(7) The^ð더 calculation캘큘레이션 of어^v브 the^ð더 service서^v비스 period피^r리어드 cannot캐낫 be비 made메이드 retroactively^r레트^r로액티^v블리 to투 before비^f포 the^ð더 year이어 the^ð더 Government거^v버먼트 was워즈 established.이스태블리시트

⑧ 제3항 및 제6항에 따라 가산(加算)된 기간 또는 제4항 및 제5항에 따른 복무기간은 제37조에 따른 퇴직수당(이하 "퇴직수당"이라 한다)을 지급할 때에는 제1항의 복무기간에 합산하거나 산입하지 아니한다.

⑨ 퇴직수당 지급과 관련하여 복무기간을 계산할 때에는 다음 각 호의 사유로 인한 휴직을 제외한 휴직기간, 직위해제기간 및 정직기간은 그 기간의 2분의 1을 각각 뺀다.
