Enforcement Decree of the Act on the Structural Improvement of the Financial Industry, Article 5-11 (Recommendation of Liquidators or Bankruptcy Trustees)

①법 제15조제1항 각 호 외의 부분 후단에서 "대통령령으로 정하는 최대채권자"란 법 제14조의6제1항에 따른 관리인이 해산 또는 파산한 부보금융회사의 영업정지일 또는 계약이전결정일을 기준으로 그 재산상황을 조사한 결과 해당 부보금융회사에 대하여 전체 채권액의 100분의 50을 초과하는 채권(영업정지일 또는 계약이전결정일 이후의 「예금자보호법」에 따른 예금보험공사 또는 정리금융회사의 보험금지급, 채권매입 또는 자금지원 등으로 인한 채권을 포함한다)을 가지는 것으로 판명된 자를 말한다. <개정 2005.5.26, 2016.3.11, 2016.9.29>

②법 제15조제1항제1호에서 "대통령령으로 정하는 금융전문가"란 다음 각 호의 어느 하나에 해당하는 자를 말한다. 다만, 청산인 또는 파산관재인을 선임하는 금융기관의 주주, 해당 금융기관과 채권ㆍ채무 등의 이해관계가 있는 자 및 해당 금융기관의 임원의 결격사유에 해당하는 자는 제외한다. <개정 2008.2.29, 2016.9.29>
