Enforcement Decree of the Special Measures Act on Deregulation of Business Activities, Article 10 (Special Provisions on Factory Expansion)

① 특별자치도지사 또는 시장ㆍ군수ㆍ구청장은 법 제16조제1항에 따라 기존 공장(1993년 7월 1일 당시 등록된 공장을 말한다. 이하 이 항에서 같다)이 다음 각 호의 요건 모두에 해당하는 경우에는 공장증설을 허가할 수 있다. 다만, 제4호의 요건은 자연보전권역에서 공장을 증설하는 경우에만 적용한다. <개정 2018.1.16>

② 특별자치도지사 또는 시장ㆍ군수ㆍ구청장은 법 제16조제2항 각 호의 어느 하나에 해당하는 공장을 보유한 중소기업자가 기존 공장의 시설자동화 또는 공정개선을 하는 데 필요하다고 인정되는 경우에는 3천제곱미터 이내에서 공장증설을 승인할 수 있다. 다만, 시설자동화 또는 공정개선을 위하여 필요한 경우로서 국제법규, 수출상대국 또는 국내 법령에 규정된 규격ㆍ인증ㆍ안전ㆍ위생기준 등을 충족하기 위하여 불가피하다고 인정되는 경우에는 1만 2천제곱미터 이내에서 공장증설을 승인할 수 있다.
