농약관리법 제26조(이의신청 특례)

① 이 법에 따른 처분을 받은 자는 그 처분을 받은 날부터 30일 이내에 농촌진흥청장에게 서면으로 이의를 신청할 수 있다. <개정 2011.7.25, 2021.6.15, 2023.7.25>

② 농촌진흥청장은 이 법에 따른 처분에 대한 이의신청을 받으면 지체 없이 신청인에게 날짜와 장소를 통지하여 신청인이나 그 대리인에게 의견을 진술할 기회를 주어야 한다. 다만, 그 신청인이나 대리인이 정당한 사유 없이 이에 응하지 아니하거나 주소불명(住所不明) 등으로 의견진술의 기회를 줄 수 없는 경우에는 그러하지 아니하다. <개정 2023.7.25>

③ 농촌진흥청장은 이 법에 따른 처분에 대한 이의신청을 받은 날부터 60일 이내에 심사를 하여 그 결과를 신청인에게 알려야 한다. 이 경우 그 결과의 통지 기간은 연장할 수 없다. <개정 2023.7.25>

④ 농촌진흥청장은 제3항에 따라 심사 결과를 알릴 때에는 신청인이 심사 결과의 통지를 받은 날부터 90일 이내에 행정심판을 청구할 수 있다는 뜻을 부기(附記)하여야 한다.
