농지법 제12조(처분명령의 유예)

①시장(구를 두지 아니한 시의 시장을 말한다. 이하 이 조에서 같다)ㆍ군수 또는 구청장은 제10조제1항에 따른 처분의무 기간에 처분 대상 농지를 처분하지 아니한 농지 소유자가 다음 각 호의 어느 하나에 해당하면 처분의무 기간이 지난 날부터 3년간 제11조제1항에 따른 처분명령을 직권으로 유예할 수 있다. <개정 2008.12.29>

②시장ㆍ군수 또는 구청장은 제1항에 따라 처분명령을 유예 받은 농지 소유자가 처분명령 유예 기간에 제1항 각 호의 어느 하나에도 해당하지 아니하게 되면 지체 없이 그 유예한 처분명령을 하여야 한다.

③농지 소유자가 처분명령을 유예 받은 후 제2항에 따른 처분명령을 받지 아니하고 그 유예 기간이 지난 경우에는 제10조제1항에 따른 처분의무에 대하여 처분명령이 유예된 농지의 그 처분의무만 없어진 것으로 본다.
