대기환경보전법 시행령 제26조(연도별 부과금산정지수 및 위반횟수별 부과계수)

① 제24조제1항에 따른 연도별 부과금산정지수는 매년 전년도 부과금산정지수에 전년도 물가상승률 등을 고려하여 기후에너지환경부장관이 고시하는 가격변동지수를 곱한 것으로 한다. <개정 2025.10.1>

② 제24조제1항에 따른 위반횟수별 부과계수는 다음 각 호의 구분에 따른 비율을 곱한 것으로 한다.

③ 제2항에 따른 위반횟수는 배출허용기준을 초과하여 제23조에 따른 부과금 부과대상 오염물질 등을 배출하여 법 제33조, 법 제34조, 법 제36조제1항 또는 법 제38조에 따른 개선명령, 조업정지명령, 허가취소, 사용중지명령 또는 폐쇄명령을 받은 횟수로 한다. 이 경우 위반횟수는 사업장의 배출구별로 위반행위가 있었던 날 이전의 최근 2년을 단위로 산정한다. <개정 2021.6.29>

④ 자동측정사업장의 경우에는 제3항에도 불구하고 30분 평균치가 배출허용기준을 초과하는 횟수를 위반횟수로 하되, 30분 평균치가 24시간 이내에 2회 이상 배출허용기준을 초과하는 경우에는 위반횟수를 1회로 보고, 제21조제3항에 따라 개선계획서를 제출하고 배출허용기준을 초과하는 경우에는 개선기간 중의 위반횟수를 1회로 본다. 이 경우 위반횟수는 각 배출구마다 제23조제2항 각 호에 따른 오염물질별로 3개월을 단위로 산정한다. <개정 2010.3.26, 2016.3.29>
