대통령기록물 관리에 관한 법률 시행령 제10조의3(전직 대통령 등의 방문 열람)

① 대통령기록관의 장은 전직 대통령이 법 제18조제1항제1호에 따라 대통령기록물을 열람하려는 경우에는 열람을 위한 전용 장소 및 시설이나 그 밖에 열람에 필요한 편의를 제공하여야 한다. 이 경우 열람을 위한 전용 장소 및 시설은 대통령기록관 내에 두거나 「공공기록물 관리에 관한 법률」 제3조제5호에 따른 영구기록물관리기관의 장과 협의하여 해당 영구기록물관리기관 내의 장소 및 시설을 활용할 수 있다. <개정 2021.3.9>

② 전직 대통령, 평시대리인 또는 유고시대리인등이 같은 조 제1항제1호에 따른 열람을 하려는 경우에는 대통령기록관의 장이 정하는 열람신청서를 대통령기록관의 장에게 제출해야 한다. 이 경우 평시대리인은 대리 권한을 증명하는 서면을 대통령기록관의 장에게 제출해야 한다. <개정 2021.3.9, 2023.8.8>

③ 대통령기록관의 장은 유고시대리인등이 제2항에 따라 법 제18조제1항제1호에 따른 열람을 신청하는 경우에는 이 영 제10조의7에 따라 열람이 가능한 대통령기록물을 지체 없이 유고시대리인등이 열람할 수 있도록 해야 한다. 다만, 대통령지정기록물의 경우에는 전문위원회의 심의를 거쳐 열람신청서를 제출받은 날부터 30일 이내에 법 제18조제1항제1호에 따른 열람 가능 여부를 통보해야 하며, 전문위원회의 심의 등에 필요한 경우 30일의 범위에서 한차례만 그 기간을 연장할 수 있다. <신설 2023.8.8>
