① 전직 대통령의 가족이 법 제18조제3항에 따라 유고시대리인등을 추천하는 경우에는 대통령기록관의 장이 정하는 유고시대리인등 지정 요청서를 대통령기록관의 장에게 서면으로 제출해야 한다. 이 경우 유고시대리인등 지정 요청서에는 추천 목적, 유고시대리인등의 지정기간이 포함돼야 한다.

③ 대통령기록관의 장은 제1항에 따라 유고시대리인등 지정 요청서를 제출받은 경우에는 전문위원회의 심의를 거쳐 유고시대리인등 지정 요청서를 제출받은 날부터 45일 이내에 유고시대리인등을 지정하고 그 결과를 전직 대통령의 가족과 지정된 유고시대리인등에게 통보해야 한다. 다만, 전문위원회의 심의 등에 필요한 경우 45일의 범위에서 한차례만 그 기간을 연장할 수 있다.
