댐건설ㆍ관리 및 주변지역지원 등에 관한 법률 제16조의2(댐건설 완료의 고시 전 댐의 사용)

① 댐건설사업시행자는 댐건설 완료의 고시가 이루어진 후가 아니면 댐을 사용할 수 없다.

② 댐건설사업시행자는 제1항에도 불구하고 긴급한 용수 공급, 홍수 조절 등이 필요하다고 인정하는 경우에는 댐건설 완료의 고시 전이라도 해당 댐을 사용할 수 있다. 다만, 기후에너지환경부장관 또는 시ㆍ도지사가 아닌 댐건설사업시행자는 기후에너지환경부장관(시장ㆍ군수가 댐건설사업시행자인 경우에는 시ㆍ도지사를 말한다)의 승인을 받은 경우로 한정한다. <개정 2018.6.8, 2025.10.1>
