도로교통법 시행령 제36조(점유자등이 없는 경우의 조치)

① 경찰서장은 제34조제1항에 따라 공고를 한 날부터 6개월이 지나도 해당 인공구조물 등을 반환받을 점유자등을 알 수 없거나 점유자등이 반환을 요구하지 아니하는 경우에는 그 인공구조물 등을 매각하여 그 대금을 보관할 수 있다.

② 제1항에 따른 매각대금은 공고한 날부터 5년이 지나도 그 대금을 반환받을 자를 알 수 없거나 점유자등이 반환을 요구하지 아니하는 경우에는 국고에 귀속한다.
