도로법 제89조(타공작물의 공사비용)

① 제33조제1항에 따라 도로관리청이 타공작물의 관리자에게 도로공사를 시행하도록 하거나 도로의 유지ㆍ관리를 하게 한 경우 그 비용은 이 법에 따라 해당 도로에 관한 비용을 부담하여야 할 자가 부담한다.

② 도로관리청은 제1항에도 불구하고 제33조제1항에 따른 도로공사의 시행 또는 도로의 유지ㆍ관리로 타공작물의 관리자가 이익을 얻을 때에는 해당 타공작물의 관리자에게 그가 얻는 이익의 범위에서 제1항에 따른 비용의 일부를 부담시킬 수 있다.

③ 제33조제1항에 따라 도로관리청이 직접 시행하는 타공작물에 관한 공사나 타공작물에 대한 관리에 필요한 비용은 해당 타공작물의 관리자가 부담한다. 다만, 도로관리청이 속해 있는 지방자치단체가 해당 타공작물에 관한 공사나 타공작물에 대한 관리로 이익을 얻으면 그 수익의 범위에서 비용의 일부를 그 지방자치단체가 부담할 수 있다.
