도선법 시행령 제3조의3(손실보상의 절차 및 방법)

① 법 제6조의4제1항에 따라 손실을 보상받으려는 사람은 해양수산부령으로 정하는 손실보상금 지급 청구서에 손실내용과 손실금액을 증명할 수 있는 서류를 첨부하여 해양수산부장관에게 제출해야 한다.

② 해양수산부장관은 제1항에 따른 청구를 받은 경우 손실보상금의 산정을 위하여 필요하면 손실보상을 청구한 사람에게 증빙ㆍ보완 자료의 제출을 요구할 수 있으며, 관계 분야의 전문기관이나 전문가로 하여금 손실 항목에 대한 감정, 평가 또는 조사 등을 하게 할 수 있다.

(2) Upon어판 receiving^r러시^v빙 a어 request^r리퀘스트 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 may,메이 where웨어 necessary네서세^r리 to투 calculate캘큘레잇 the^ð더 compensation캄펀세이션 for^f포 losses,로시즈 require^r리콰이어 the^ð더 person퍼슨 who후 requested^r리퀘스티드 the^ð더 compensation캄펀세이션 to투 submit서브밋 supporting서포팅 or오 supplementary서플러멘터^r리 materials,머티^r리얼즈 and앤드 may메이 have해^v브 a어 specialized스페셜라이즈드 institution인스티투션 or오 expert엑스펏 in인 the^ð더 relevant^r렐러^v번트 field^f필드 appraise,어프^r레이즈 evaluate이^v밸류에잇 or오 investigate인^v베스터게잇 the^ð디 items아이텀즈 of어^v브 loss.로스

③ 해양수산부장관은 특별한 사유가 없으면 손실보상금 지급 청구서를 받은 날부터 60일 이내에 손실보상금 지급 여부 및 보상금액을 결정해야 한다.

(3) Unless언레스 there^ð데어 are아 special스페실 reasons,^r리즌즈 the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 shall섈 decide디사이드 whether웨^ð더 to투 pay페이 compensation캄펀세이션 for^f포 losses로시즈 and앤드 the^ð디 amount어마운트 of어^v브 compensation캄펀세이션 within위^ð딘 60 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 the^ð더 request^r리퀘스트 for^f포 payment페이먼트 of어^v브 compensation캄펀세이션 for^f포 losses.로시즈

④ 해양수산부장관은 다음 각 호의 어느 하나에 해당하는 경우에는 그 청구를 각하(却下)하는 결정을 해야 한다.

⑤ 해양수산부장관은 제3항 또는 제4항에 따른 결정일부터 10일 이내에 다음 각 호의 구분에 따른 내용을 청구인에게 통지하고, 손실보상금을 지급하기로 결정한 경우에는 특별한 사유가 없으면 통지한 날부터 30일 이내에 손실보상금을 지급해야 한다.

(5) Within위^ð딘 10 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 the^ð더 decision디시전 under언더 paragraph패^r러그^r래^f프 (3) or오 (4), the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 shall섈 notify노우터^f파이 the^ð더 claimant클레이먼트 of어^v브 the^ð더 following,^f팔로잉 classified클래서^f파이드 as애즈 follows,^f팔로즈 and앤드 where웨어 a어 decision디시전 has해즈 been빈 made메이드 to투 pay페이 the^ð더 compensation캄펀세이션 for^f포 losses,로시즈 shall섈 pay페이 it잇 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 notification노우터^f퍼케이션 unless언레스 there^ð데어 are아 special스페실 reasons:^r리즌즈

⑥ 해양수산부장관은 손실보상금을 지급받을 사람이 지정하는 예금계좌(「우체국예금ㆍ보험에 관한 법률」에 따른 체신관서 또는 「은행법」에 따른 은행의 계좌를 말한다)에 입금하는 방법으로 손실보상금을 지급한다. 다만, 손실보상금을 지급받을 사람이 체신관서 또는 은행이 없는 지역에 거주하는 등 부득이한 사유가 있는 경우에는 그 손실보상금을 지급받을 사람의 신청에 따라 현금으로 지급할 수 있다.

⑦ 손실보상금은 일시불로 지급하되, 예산 부족 등의 사유로 일시불로 지급할 수 없는 특별한 사정이 있는 경우에는 청구인의 동의를 받아 분할하여 지급할 수 있다.

⑧ 제1항부터 제7항까지에서 규정한 사항 외에 손실보상금의 청구 및 지급에 필요한 사항은 해양수산부장관이 정한다.
