Enforcement Decree of the Act on Honorable Treatment of Persons of Distinguished Service for Independence, Article 9 (Amount of Veterans Benefits, etc.)
① 법 제11조제3항에 따라 양로ㆍ양육 지원을 받고 있는 경우에 지급하지 아니하는 보상금의 금액은 별표 2의2와 같다.
(1) The amount of compensation not paid where support for nursing home care or child-rearing is being received under Article 11 (3) of the Act is as set forth in Attached Table 2-2.
② 법 제11조제5항 단서에서 "정보통신망(「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망을 말한다. 이하 같다)의 손상 등 대통령령으로 정하는 부득이한 사유가 있는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <신설 2016.6.21, 2023.4.11>
(2) The "unavoidable grounds prescribed by Presidential Decree, such as damage to an information and communications network (meaning an information and communications network under Article 2 (1) 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.; the same applies below)" in the proviso of Article 11 (5) of the Act means any of the following cases:
1. 보훈급여금이 입금되는 예금계좌[「우체국예금ㆍ보험에 관한 법률」에 따른 체신관서(이하 "체신관서"라 한다) 또는 「은행법」에 따른 은행(이하 "은행"이라 한다)의 계좌를 말한다. 이하 같다]가 개설된 체신관서 또는 은행이 폐업, 업무정지, 정보통신 장애 등으로 정상영업이 불가능하여 보훈급여금을 이체할 수 없는 경우
1. Where the postal office [meaning a postal office under the Act on Postal Savings and Insurance (hereinafter referred to as the "postal office") or a bank under the Banking Act (hereinafter referred to as a "bank"); the same applies below] holding the deposit account into which veterans benefits are deposited cannot transfer veterans benefits because normal business is impossible owing to closure, suspension of business, or information and communications failure, etc.
2. 그 밖에 국가보훈부장관이 현금지급이 불가피하다고 인정하는 경우

③ 법 제11조제7항에 따른 보훈급여금의 지급에 필요한 사항에 관하여는 「국가유공자 등 예우 및 지원에 관한 법률 시행령」 제24조, 제24조의2, 제29조, 제30조, 제32조의2, 제32조의3 및 제33조를 준용한다. <개정 2016.6.21>
(3) Articles 24, 24-2, 29, 30, 32-2, 32-3, and 33 of the Enforcement Decree of the Act on Honorable Treatment and Support for Persons of Distinguished Service to the State apply mutatis mutandis to matters necessary for the payment of veterans benefits under Article 11 (7) of the Act.
