마약류 관리에 관한 법률 제16조(봉함)
Act on the Control of Narcotics, etc., Article 16 (Sealing)
① 다음 각 호의 어느 하나에 해당하는 자가 마약류를 판매하거나 수출 또는 양도할 때에는 그 용기나 포장을 봉함(封緘)하여야 한다. 이 경우 봉함은 그 봉함을 뜯지 아니하고서는 용기나 포장을 개봉할 수 없고, 개봉한 후에는 쉽게 원상으로 회복시킬 수 없도록 하여야 한다. <개정 2013.3.23, 2016.2.3>
(1) When any of the following persons sells, exports or transfers narcotics, he or she shall seal the container or package. In such cases, the seal shall be such that the container or package cannot be opened without breaking the seal and cannot easily be restored to its original state once opened:
1. 마약류수출입업자
1. A narcotics importer/exporter;
2. 마약류제조업자
2. A narcotics manufacturer;
3. 마약류원료사용자
3. A narcotics raw material user;
4. 마약류취급학술연구자
4. A narcotics handling academic researcher;
5. 마약류취급승인자
5. An approved narcotics handling person.
② 마약류취급자ㆍ마약류취급승인자는 제1항에 따라 봉함을 하지 아니한 마약류를 수수하지 못한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다. <개정 2013.3.23, 2016.2.3>
(2) A narcotics handler or an approved narcotics handling person shall not give or receive narcotics that have not been sealed under paragraph (1); provided, that this does not apply in any of the following cases:
1. 마약류취급자가 제9조제2항제3호에 따라 소유 또는 관리하던 마약 또는 향정신성의약품을 원소유자 등 마약류취급자에게 반품하려는 경우
1. Where a narcotics handler intends to return narcotic drugs or psychotropic drugs that he or she owned or managed to a narcotics handler who is the original owner, etc. under Article 9 (2) 3;
2. 제13조에 따라 보유하고 있는 마약류를 마약류취급자에게 양도하는 경우 등 대통령령으로 정하는 사유로 식품의약품안전처장의 승인을 받은 경우
2. Where approval of the Minister of Food and Drug Safety has been obtained for a reason prescribed by Presidential Decree, such as the transfer of narcotics held under Article 13 to a narcotics handler.
