Enforcement Decree of the Water Environment Conservation Act, Article 76 (Standards and Procedures for Designating Management Areas)
① 법 제54조제1항에 따른 비점오염원관리지역(이하 "관리지역"이라 한다)의 지정기준은 다음 각 호와 같다. <개정 2017.1.17, 2018.1.16, 2021.11.23, 2025.10.1>
(1) The standards for designating a non-point pollution source management area under Article 54 (1) of the Act (hereinafter referred to as a "management area") are as follows:
1. 「환경정책기본법 시행령」 제2조에 따른 하천 및 호소의 물환경에 관한 환경기준 또는 법 제10조의2제1항에 따른 수계영향권별, 호소별 물환경 목표기준에 미달하는 유역으로 유달부하량(流達負荷量) 중 비점오염 기여율이 50퍼센트 이상인 지역
1. A basin that falls short of the environmental standards for the water environment of rivers and lakes under Article 2 of the Enforcement Decree of the Framework Act on Environmental Policy, or the target water environment standards by water system influence area or lake under Article 10-2 (1) of the Act, where the contribution rate of non-point pollution in the delivered load is 50 percent or more;
2. 다음 각 목의 어느 하나에 해당하는 지역으로서 비점오염물질에 의하여 중대한 위해(危害)가 발생되거나 발생될 것으로 예상되는 지역
2. An area falling under any of the following items where serious harm has occurred or is expected to occur due to non-point pollutants:
가. 법 제31조의2제1항에 따라 지정된 중점관리저수지를 포함하는 지역
(a) An area including an intensively managed reservoir designated under Article 31-2 (1) of the Act;
나. 「해양환경관리법」 제15조제1항제2호에 따른 특별관리해역을 포함하는 지역
(b) An area including a specially managed sea area under Article 15 (1) 2 of the Marine Environment Management Act;
다. 「지하수법」 제12조제1항에 따라 지정된 지하수보전구역을 포함하는 지역
(c) An area including a groundwater conservation zone designated under Article 12 (1) of the Groundwater Act;
라. 비점오염물질에 의하여 어류폐사(斃死) 및 녹조발생이 빈번한 지역으로서 관리가 필요하다고 인정되는 지역
(d) An area where fish deaths and algal blooms frequently occur due to non-point pollutants and management is recognized as necessary;
마. 지질이나 지층 구조가 특이하여 특별한 관리가 필요하다고 인정되는 지역
(e) An area where special management is recognized as necessary because of unusual geology or strata structure;
3. 법 제53조의5제2항제4호가목에 따른 불투수면적률이 25퍼센트 이상인 지역으로서 비점오염원 관리가 필요한 지역
3. An area where the impervious surface ratio under Article 53-5 (2) 4 (a) of the Act is 25 percent or more and non-point pollution source management is necessary.
4. 「산업입지 및 개발에 관한 법률」에 따른 국가산업단지, 일반산업단지로 지정된 지역으로 비점오염원 관리가 필요한 지역
4. An area designated as a national industrial complex or general industrial complex under the Industrial Sites and Development Act where non-point pollution source management is necessary;

6. 그 밖에 기후에너지환경부령으로 정하는 지역
6. Other areas prescribed by Ordinance of the Ministry of Climate, Energy and Environment.
② 기후에너지환경부장관이 법 제54조제1항에 따라 관리지역을 지정하려는 경우에는 다음 각 호의 내용을 포함하는 지정계획을 마련하여 해당 시ㆍ도지사와 협의한 후 법 제54조제5항에 따라 관리지역을 고시한다. <개정 2025.10.1>
(2) Where the Minister of Climate, Energy and Environment intends to designate a management area pursuant to Article 54 (1) of the Act, the Minister shall prepare a designation plan including the following, consult with the relevant Mayor/Do Governor, and then publicly notify the management area pursuant to Article 54 (5) of the Act:
1. 관리지역의 지정이 필요한 사유
1. The reason a management area must be designated;
2. 해당 지역에서의 비점오염원이 수질오염에 미치는 영향
2. The impact of non-point pollution sources in the area on water pollution;
3. 관리지역의 지정이 필요한 구체적인 지정 범위
3. The specific scope of designation required for the management area;
4. 그 밖에 기후에너지환경부령으로 정하는 관리지역의 지정에 필요한 사항
4. Other matters necessary for designating a management area as prescribed by Ordinance of the Ministry of Climate, Energy and Environment.
③ 시ㆍ도지사가 법 제54조제2항에 따라 관리지역으로의 지정을 요청하는 경우에는 제2항 각 호의 내용을 포함하는 지정요청서를 작성하여 기후에너지환경부장관에게 제출하여야 한다. 이 경우 기후에너지환경부장관은 관리지역으로의 지정을 요청받은 지역이 제1항 각 호의 어느 하나에 해당한다고 인정하는 경우에는 해당 지역을 법 제54조제5항에 따라 관리지역으로 고시한다. <개정 2025.10.1>
(3) Where a Mayor/Do Governor requests designation as a management area pursuant to Article 54 (2) of the Act, the Mayor/Do Governor shall prepare a designation request including the matters in the subparagraphs of paragraph (2) and submit it to the Minister of Climate, Energy and Environment. In such cases, where the Minister of Climate, Energy and Environment recognizes that the area for which designation as a management area is requested falls under any subparagraph of paragraph (1), the Minister shall publicly notify the area as a management area pursuant to Article 54 (5) of the Act.
