민법 제289조의2(구분지상권)

①지하 또는 지상의 공간은 상하의 범위를 정하여 건물 기타 공작물을 소유하기 위한 지상권의 목적으로 할 수 있다. 이 경우 설정행위로써 지상권의 행사를 위하여 토지의 사용을 제한할 수 있다.

②제1항의 규정에 의한 구분지상권은 제3자가 토지를 사용ㆍ수익할 권리를 가진 때에도 그 권리자 및 그 권리를 목적으로 하는 권리를 가진 자 전원의 승낙이 있으면 이를 설정할 수 있다. 이 경우 토지를 사용ㆍ수익할 권리를 가진 제3자는 그 지상권의 행사를 방해하여서는 아니된다.
