민법 제483조(일부의 대위)

①채권의 일부에 대하여 대위변제가 있는 때에는 대위자는 그 변제한 가액에 비례하여 채권자와 함께 그 권리를 행사한다.

②전항의 경우에 채무불이행을 원인으로 하는 계약의 해지 또는 해제는 채권자만이 할 수 있고 채권자는 대위자에게 그 변제한 가액과 이자를 상환하여야 한다.
