민법 제851조(부의 자 출생 전 사망 등과 친생부인)

부(夫)가 자(子)의 출생 전에 사망하거나 부(夫) 또는 처(妻)가 제847조제1항의 기간내에 사망한 때에는 부(夫) 또는 처(妻)의 직계존속이나 직계비속에 한하여 그 사망을 안 날부터 2년내에 친생부인의 소를 제기할 수 있다.
