민사소송법 제389조(화해비용)

화해비용은 화해가 성립된 경우에는 특별한 합의가 없으면 당사자들이 각자 부담하고, 화해가 성립되지 아니한 경우에는 신청인이 부담한다. 다만, 소제기신청이 있는 경우에는 화해비용을 소송비용의 일부로 한다.
