민사소송법 제395조(항소권의 포기방식)

①항소권의 포기는 항소를 하기 이전에는 제1심 법원에, 항소를 한 뒤에는 소송기록이 있는 법원에 서면으로 하여야 한다.

②항소권의 포기에 관한 서면은 상대방에게 송달하여야 한다.

③항소를 한 뒤의 항소권의 포기는 항소취하의 효력도 가진다.
