① 다단계판매업자는 다단계판매원에게 고지한 후원수당의 산정 및 지급 기준과 다르게 후원수당을 산정ㆍ지급하거나 그 밖의 부당한 방법으로 다단계판매원을 차별하여 대우하여서는 아니 된다.

③ 다단계판매업자가 다단계판매원에게 후원수당으로 지급할 수 있는 총액은 다단계판매업자가 다단계판매원에게 공급한 재화등의 가격(부가가치세를 포함한다) 합계액(이하 이 조에서 "가격합계액"이라 한다)의 100분의 35에 해당하는 금액을 초과하여서는 아니 되며, 가격합계액 및 후원수당 등의 구체적인 산정 방법은 다음과 같다.

1. 가격합계액은 출고 또는 제공 시점을 기준으로 할 것

4. 가격합계액을 산정할 때 위탁의 방법으로 재화등을 공급하는 경우에는 위탁을 받은 다단계판매업자가 다단계판매원에게 판매한 가격을 기준으로 하고, 중개의 방법으로 재화등을 공급하는 경우에는 다단계판매자가 중개를 의뢰한 사업자로부터 받은 수수료를 기준으로 한다.

⑤ 다단계판매업자는 일정 수의 하위판매원을 모집하거나 후원하는 것을 조건으로 하위판매원 또는 그 하위판매원의 판매 실적에 관계없이 후원수당을 차등하여 지급하여서는 아니 된다.
