벌금 미납자의 사회봉사 집행에 관한 특례법 제12조(사회봉사 대상자의 벌금 납입)

① 사회봉사 대상자는 사회봉사의 이행을 마치기 전에 벌금의 전부 또는 일부를 낼 수 있다.

② 사회봉사 집행 중에 벌금을 내려는 사회봉사 대상자는 보호관찰소의 장으로부터 사회봉사집행확인서를 발급받아 주거지를 관할하는 지방공소청의 검사에게 제출하여야 한다. <개정 2026.3.24>

③ 제2항의 사회봉사집행확인서를 제출받은 검사는 미납한 벌금에서 이미 집행한 사회봉사시간에 상응하는 금액을 공제하는 방법으로 남은 벌금을 산정하여 사회봉사 대상자에게 고지한다.

④ 검사는 사회봉사 대상자가 벌금을 전부 또는 일부 낸 경우 그 사실을 지체 없이 사회봉사를 집행 중인 보호관찰소의 장에게 통보하여야 한다.

⑤ 사회봉사 대상자가 미납벌금의 일부를 낸 경우 검사는 법원이 결정한 사회봉사시간에서 이미 납입한 벌금에 상응하는 사회봉사시간을 공제하는 방법으로 남은 사회봉사시간을 다시 산정하여 사회봉사 대상자와 사회봉사를 집행 중인 보호관찰소의 장에게 통보하여야 한다.
