별정우체국법 시행령 제18조의2(연금수급자의 신상 조사 등)

① 연금관리단은 연금인 급여에 영향을 미치는 신분상의 변동사항을 파악하기 위하여 연금수급자(법 제24조에 따라 연금인 급여를 받는 사람을 말한다. 이하 같다)의 거주지 또는 등록기준지의 특별자치도지사, 특별자치시장, 시장, 군수 또는 구청장에게 신상 조사를 의뢰할 수 있다.

② 제1항의 조사의뢰를 받은 특별자치도지사, 특별자치시장, 시장, 군수 또는 구청장은 지체 없이 이를 조사하여 연금관리단에 통보하여야 한다.

③ 연금관리단은 법 제19조제1항에 따라 수급권의 변경 또는 소멸 등을 확인하기 위하여 수급자 또는 그 가족 등을 대상으로 수급자의 사망ㆍ이혼ㆍ생계유지 여부 등에 관한 조사를 실시하거나 이와 관련된 자료의 제출을 요구할 수 있다.

④ 외국에 거주하고 있는 수급자는 매년 5월 31일을 기준으로 신분변동 사항을 기재한 서류를 재외공관의 장(재외공관이 설치되지 아니한 국가의 경우에는 그 인접국에 있는 재외공관의 장을 말한다)의 확인을 받아 매년 6월 30일까지 연금관리단에 제출하여야 한다.

⑤ 연금관리단은 수급자가 정당한 사유 없이 제3항 또는 제4항에 따른 자료를 제출하지 아니하는 경우에는 법 제19조제5항에 따라 수급자에 대한 급여의 지급을 일시 중지할 수 있다. 이 경우 제3항 또는 제4항에 따른 자료를 제출하지 아니하면 급여의 지급이 중지될 수 있다는 사실을 미리 수급자 또는 그 가족 등에게 알려야 한다.

⑥ 연금관리단은 제5항에 따른 급여의 지급 중지 사유가 해소된 경우에는 즉시 지급을 재개하여야 한다.
