보호소년 등의 처우에 관한 법률 시행령 제16조(이송의 제한)

① 소년원장은 이송할 보호소년에 대하여 건강진단을 하고 건강상태가 이송해 갈 소년원의 교육활동에 적합하지 아니하다고 판명되면 이송을 중지하여야 한다.

② 소년원장은 다음 각 호의 어느 하나에 해당하는 보호소년을 다른 소년원으로 이송해서는 안 된다. <개정 2021.1.5, 2021.4.20>

③ 소년원장은 제2항에도 불구하고 처우상 특히 필요하다고 인정되는 사유가 있으면 처우ㆍ징계위원회의 심의를 거쳐 법무부장관의 허가를 받아 보호소년을 다른 소년원으로 이송할 수 있다. <개정 2021.4.20>
