산업재해보상보험법 시행규칙 제34조(진폐진단의 실시 등)

① 공단은 법 제91조의5제1항에 따라 요양급여 등의 청구를 받으면 요양급여 등을 청구한 사람에게 진단일자, 건강진단기관 등을 정하여 알려주어야 한다.

② 건강진단기관은 법 제91조의6제1항에 따라 진폐에 대한 진단을 의뢰받으면 「진폐의 예방과 진폐근로자의 보호 등에 관한 법률 시행규칙」 제11조제4호 및 제13조제1항제2호에 따른 검사항목에 대하여 검사를 실시하여야 한다.

③ 건강진단기관은 제2항에 따라 검사를 실시한 결과 심폐기능의 정도 등을 정확히 판정하기 곤란하다고 판단될 경우 6개월의 범위에서 진단을 연기할 수 있다.

④ 이 규칙에서 규정한 사항 외에 진폐진단에 필요한 사항은 공단이 정한다.
