상법 제162조(보관료청구권)

①창고업자는 임치물을 출고할 때가 아니면 보관료 기타의 비용과 체당금의 지급을 청구하지 못한다. 그러나 보관기간 경과후에는 출고전이라도 이를 청구할 수 있다.

②임치물의 일부출고의 경우에는 창고업자는 그 비율에 따른 보관료 기타의 비용과 체당금의 지급을 청구할 수 있다.
