상표법 제102조(상표권 등의 포기의 제한)

① 상표권자는 전용사용권자ㆍ통상사용권자 또는 질권자의 동의를 받지 아니하면 상표권을 포기할 수 없다.

② 전용사용권자는 제95조제6항에 따른 질권자 또는 통상사용권자의 동의를 받지 아니하면 전용사용권을 포기할 수 없다.

(2) An앤 exclusive익스클루시^v브 licensee라이선시 may메이 not낫 abandon어밴든 an앤 exclusive익스클루시^v브 license라이슨스 without위^ð다웃 the^ð더 consent컨센트 of어^v브 the^ð더 pledgee플레지 or오 non-exclusive난-익스클루시^v브 licensee라이선시 under언더 Article아터클 95 (6).

③ 통상사용권자는 제97조제4항에 따른 질권자의 동의를 받지 아니하면 통상사용권을 포기할 수 없다.
