상훈법 시행령 제3조(서훈의 추천)

① 서훈 추천권자는 서훈을 추천하려는 경우에는 서훈의 필요성, 서훈의 규모 및 시기 등을 미리 행정안전부장관과 협의하여야 한다. <개정 2017.7.26>

② 서훈 추천권자가 서훈을 추천할 때에는 공적심사위원회의 심사를 거쳐 서훈 예정일 30일 전까지 별지 제1호서식의 공적조서(전자문서로 된 공적조서를 포함한다)를 행정안전부장관에게 제출하여야 한다. 다만, 서훈 대상자가 외국인인 경우에는 같은 서식의 영문 공적조서를 함께 첨부하여야 한다. <개정 2017.7.26>

③ 서훈 추천권자는 법 제5조에 따라 서훈 추천권자 소속이 아닌 공무원의 서훈을 추천할 때에는 해당 공무원 소속 기관장의 동의를 받아야 한다. 다만, 추천 대상자가 외국 군인인 경우에는 국방부장관과 미리 협의하여야 하며, 그 밖의 외국인인 경우에는 외교부장관과 미리 협의하여야 한다.

④ 서훈 추천권자는 서훈 대상자의 공적심사를 위하여 필요한 경우에는 서훈 대상자 본인의 동의를 받아 관계 법령에서 정하는 바에 따라 서훈 대상자의 범죄경력과 그 밖에 필요한 정보를 제공하여 줄 것을 그 정보를 보유한 기관의 장에게 요청할 수 있다.
