Enforcement Rule of the Petroleum and Alternative Fuel Business Act, Article 45 (Reports and Inspections)
① 법 제38조제1항 및 제2항에 따라 석유정제업자, 석유수출입업자, 석유판매업자, 「송유관 안전관리법」에 따른 송유관설치자 및 송유관관리자, 석유대체연료 제조ㆍ수출입업자, 석유대체연료 판매업자 및 영 제42조에 따른 석유소비자가 보고하여야 하는 보고사항 및 보고기한 등은 별표 8과 같다. <개정 2012.5.14>
(1) The matters to be reported, reporting deadlines, etc. by petroleum refiners, petroleum exporters and importers, petroleum sellers, pipeline installers and pipeline managers under the Petroleum Oil Pipeline Safety Management Act, alternative petroleum fuel manufacturers, exporters, and importers, alternative petroleum fuel sellers, and petroleum consumers under Article 42 of the Decree under Article 38 (1) and (2) of the Act shall be as prescribed in attached Table 8.
② 법 제38조제1항에 따라 산업통상부장관, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장, 한국석유관리원 또는 공사(한국석유관리원이나 공사는 위탁받은 권한을 수행하기 위하여 필요한 경우로 한정한다)는 다음 각 호의 어느 하나에 해당하는 경우에는 소속 공무원 또는 소속 임직원으로 하여금 출입ㆍ검사 및 시료 채취를 하게 할 수 있다. <개정 2012.5.14, 2013.3.23, 2017.10.19, 2025.10.1>
(2) Under Article 38 (1) of the Act, the Minister of Industry and Trade, the Mayor/Do Governor, the head of a Si/Gun/Gu, the Korea Petroleum Quality and Distribution Authority, or the Corporation (limited to cases where necessary for the Korea Petroleum Quality and Distribution Authority or the Corporation to exercise the authority entrusted to it) may have public officials or officers and employees under its control enter, inspect, and collect samples in any of the following cases:
1. 법 제5조ㆍ제9조ㆍ제9조의2 또는 제10조에 따른 석유정제업, 석유수출입업, 국제석유거래업 또는 석유판매업의 등록(변경등록을 포함한다) 및 신고(변경신고를 포함한다)의 거짓 여부나 법 제32조 또는 제33조에 따른 석유대체연료 제조ㆍ수출입업 또는 석유대체연료 판매업의 등록(변경등록을 포함한다)의 거짓 여부를 판단하기 위하여 필요한 경우
1. Where necessary to determine whether registration (including registration of changes) and reports (including reports on changes) of a petroleum refining business, petroleum export and import business, international petroleum trading business, or petroleum sales business under Article 5, 9, 9-2, or 10 of the Act, or registration (including registration of changes) of an alternative petroleum fuel manufacturing, export, and import business or alternative petroleum fuel sales business under Article 32 or 33 of the Act, are false;
2. 법 제5조ㆍ제9조ㆍ제9조의2 또는 제10조에 따른 석유정제업, 석유수출입업, 국제석유거래업 또는 석유판매업의 등록(변경등록을 포함한다) 요건 또는 신고(변경신고를 포함한다) 요건 충족 여부나 법 제32조 또는 제33조에 따른 석유대체연료 제조ㆍ수출입업 또는 석유대체연료 판매업의 등록(변경등록을 포함한다) 요건 충족 여부를 확인하려는 경우
2. Where it is intended to verify whether the requirements for registration (including registration of changes) or reports (including reports on changes) of a petroleum refining business, petroleum export and import business, international petroleum trading business, or petroleum sales business under Article 5, 9, 9-2, or 10 of the Act, or the requirements for registration (including registration of changes) of an alternative petroleum fuel manufacturing, export, and import business or alternative petroleum fuel sales business under Article 32 or 33 of the Act, are met;
3. 법 제17조제1항 또는 제36조에 따른 석유비축의무 또는 석유대체연료 비축의무의 준수 여부를 확인하려는 경우
3. Where it is intended to verify compliance with the petroleum stockpiling obligation or the alternative petroleum fuel stockpiling obligation under Article 17 (1) or 36 of the Act;
4. 법 제18조ㆍ제19조 또는 제37조에 따른 석유 수입ㆍ판매 부과금 또는 석유대체연료 수입부과금 납부, 이의신청 및 환급의 적정 여부를 판단하기 위하여 필요한 경우
4. Where necessary to determine the appropriateness of payment of, objections to, and refunds of petroleum import and sales levies or alternative petroleum fuel import levies under Article 18, 19, or 37 of the Act;
5. 법 제21조부터 제23조까지의 규정에 따른 석유 수급의 안정을 위한 명령, 석유 배급 등의 조치 및 석유판매가격의 준수 여부를 확인하려는 경우
5. Where it is intended to verify compliance with orders for stabilizing petroleum supply and demand, measures such as petroleum rationing, and petroleum sales prices under Articles 21 through 23 of the Act;
6. 법 제29조에 따른 가짜석유제품 제조 등 행위 금지의 준수 여부를 확인하기 위하여 필요한 경우
6. Where necessary to verify compliance with the prohibition of acts such as manufacturing fake petroleum products under Article 29 of the Act;
7. 법 제38조 또는 제38조의2에 따른 보고의 거짓 여부를 확인하기 위하여 필요한 경우
7. Where necessary to verify whether reports under Article 38 or 38-2 of the Act are false;
8. 법 제39조에 따른 행위 금지의 준수 여부를 확인하려는 경우
8. Where it is intended to verify compliance with the prohibition of acts under Article 39 of the Act.
③ 산업통상부장관이 법 제38조제2항에 따라 영 제42조에 따른 석유소비자에게 그 석유 소비 상황에 관한 보고를 명하려는 경우에는 보고사항과 보고기한 등을 정하여 보고기한 10일 전에 서면으로 알려야 한다. <개정 2012.5.14, 2013.3.23, 2025.10.1>
(3) Where the Minister of Industry and Trade intends to order petroleum consumers under Article 42 of the Decree to report on their petroleum consumption status under Article 38 (2) of the Act, he or she shall determine the matters to be reported, the reporting deadline, etc. and notify them in writing 10 days before the reporting deadline.
④ 산업통상부장관, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장, 한국석유관리원 또는 공사(한국석유관리원이나 공사는 위탁받은 권한을 수행하기 위하여 필요한 경우로 한정한다)는 법 제38조제1항 및 제2항에 따라 소속 공무원 또는 소속 임직원으로 하여금 출입ㆍ검사를 하게 하는 경우에는 검사할 내용과 검사기간을 정하여 검사 시작 3일 전까지 서면으로 그 검사를 받을 자에게 알려야 한다. 다만, 법 제29조 또는 제39조제1항 각 호의 어느 하나에 해당하는 행위 금지에 관하여 검사를 하게 하는 경우에는 검사 시작과 동시에 서면이나 구두로 통지할 수 있다. <개정 2013.3.23, 2025.10.1>
(4) Where the Minister of Industry and Trade, the Mayor/Do Governor, the head of a Si/Gun/Gu, the Korea Petroleum Quality and Distribution Authority, or the Corporation (limited to cases where necessary for the Korea Petroleum Quality and Distribution Authority or the Corporation to exercise the authority entrusted to it) has public officials or officers and employees under its control enter and inspect under Article 38 (1) and (2) of the Act, it shall determine the details and period of inspection and notify the person subject to inspection in writing at least three days before the commencement of the inspection: Provided, That where an inspection is conducted regarding the prohibition of acts falling under Article 29 or any subparagraph of Article 39 (1) of the Act, notice may be given in writing or orally at the same time as the commencement of the inspection.
