성폭력범죄자의 성충동 약물치료에 관한 법률 제18조(치료명령 임시해제의 심사 및 결정)

① 심사위원회는 임시해제를 심사할 때에는 치료명령을 받은 사람의 인격, 생활태도, 치료명령 이행상황 및 재범의 위험성에 대한 전문가의 의견 등을 고려하여야 한다. <개정 2020.2.4>

② 심사위원회는 임시해제의 심사를 위하여 필요한 때에는 보호관찰소의 장으로 하여금 필요한 사항을 조사하게 하거나 치료명령을 받은 사람이나 그 밖의 관계인을 직접 소환ㆍ심문 또는 조사할 수 있다. <개정 2020.2.4>

③ 제2항의 요구를 받은 보호관찰소의 장은 필요한 사항을 조사하여 심사위원회에 통보하여야 한다.

④ 심사위원회는 치료명령을 받은 사람이 치료명령이 계속 집행될 필요가 없을 정도로 개선되어 죄를 다시 범할 위험성이 없다고 인정하는 때에는 치료명령의 임시해제를 결정할 수 있다. <개정 2020.2.4>

⑤ 심사위원회는 치료명령의 임시해제를 하지 아니하기로 결정한 때에는 결정서에 그 이유를 명시하여야 한다. <개정 2020.2.4>
