수산식품산업의 육성 및 지원에 관한 법률 제34조(우수수산식품등인증 및 우수수산식품등인증기관의 사후관리)

① 해양수산부장관은 우수수산식품등인증을 받은 수산식품의 품질수준의 유지와 소비자보호를 위하여 필요하다고 인정되는 경우에는 관계 공무원 및 우수수산식품등인증기관의 담당자로 하여금 다음 각 호의 사항을 하게 할 수 있다.

② 해양수산부장관은 우수수산식품등인증 업무의 적정한 관리를 위하여 필요한 경우에는 우수수산식품등인증기관에 대하여 우수수산식품등인증 정기심사 또는 제1항제1호부터 제3호까지의 규정에 따른 업무에 관한 사항을 보고하게 하거나 자료를 제출하게 할 수 있으며, 관계 공무원으로 하여금 사무소 등을 출입하여 관계 서류나 시설ㆍ장비 등을 점검하게 할 수 있다.

③ 우수수산식품등인증을 받은 자 및 우수수산식품등인증기관은 해양수산부령으로 정하는 바에 따라 인증심사자료, 가공시설의 관리, 수산식품 첨가물의 사용 및 우수수산식품등인증을 받은 수산식품의 거래에 관한 자료 등 관련 문서를 비치ㆍ보존하여야 한다.

④ 제1항 또는 제2항에 따른 조사ㆍ열람ㆍ수거 또는 점검(이하 이 조에서 "조사등"이라 한다)을 하려는 경우에는 조사등을 하기 7일 전까지 해당 수산식품의 소유자ㆍ점유자ㆍ관리인 또는 우수수산식품등인증기관에 조사등의 일시, 목적 및 내용 등을 통지하여야 한다. 다만, 긴급을 요하거나 조사등의 계획이 알려짐으로써 그 목적을 달성할 수 없다고 인정되는 경우에는 통지하지 아니할 수 있다.

⑤ 조사등을 하는 자는 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.

⑥ 조사등을 하는 때에는 우수수산식품등인증을 받은 수산식품의 소유자ㆍ점유자ㆍ관리인 또는 우수수산식품등인증기관은 정당한 사유 없이 이를 거부ㆍ방해 또는 기피하여서는 아니 된다.

⑦ 제1항부터 제6항까지의 규정에 따른 우수수산식품등인증 및 우수수산식품등인증기관의 사후관리에 필요한 구체적인 사항은 해양수산부령으로 정한다.
