시설물의 안전 및 유지관리에 관한 특별법 시행령 제28조(시설물의 성능평가)
Enforcement Decree of the Special Act on the Safety and Maintenance of Facilities, Article 28 (Performance Evaluation of Facilities|18)
① 법 제40조제1항에서 "도로, 철도, 항만, 댐 등 대통령령으로 정하는 시설물"이란 별표 13과 같다.
(1) The term "facilities prescribed by Presidential Decree, such as roads, railways, ports, and dams" in Article 40 (1) of the Act is as set out in Table 13.
② 법 제40조제1항에 따른 성능평가의 실시시기는 별표 3과 같다.
(2) The timing of conduct of performance evaluations under Article 40 (1) of the Act is as set out in Table 3.
③ 법 제40조제1항에 따라 성능평가를 실시하는 자는 보유 기술인력 또는 등록분야에 따라 별표 9에 따른 실시범위 안에서 성능평가를 실시하여야 한다.
(3) A person who conducts a performance evaluation under Article 40 (1) of the Act shall conduct the performance evaluation within the scope of conduct under Table 9 according to the technical personnel held or the registered field.
④ 관리주체는 법 제40조제1항에 따라 성능평가를 실시하는 경우 정밀안전점검 또는 정밀안전진단을 포함하여 실시할 수 있다.
(4) When conducting a performance evaluation under Article 40 (1) of the Act, a management entity may include a precision safety inspection or precision safety diagnosis.
⑤ 관리주체는 성능평가를 실시할 때 다음 각 호의 어느 하나에 해당하는 정밀안전점검 또는 정밀안전진단에서 실시한 현장조사ㆍ시험 등의 결과를 활용할 수 있다.
(5) When conducting a performance evaluation, a management entity may use the results of field investigations, tests, etc. conducted in a precision safety inspection or precision safety diagnosis falling under any of the following:
1. 성능평가에 포함하여 실시한 정밀안전점검 또는 정밀안전진단
1. A precision safety inspection or precision safety diagnosis conducted as part of a performance evaluation;
2. 성능평가를 하는 날부터 1년 이내에 실시한 정밀안전점검 또는 정밀안전진단
2. A precision safety inspection or precision safety diagnosis conducted within one year from the date of the performance evaluation.
⑥ 성능평가를 실시한 자는 법 제40조제3항에 따라 다음 각 호의 사항을 포함하여 성능평가 결과보고서를 서면 또는 전자문서로 작성해야 한다. <개정 2020.2.18>
(6) A person who has conducted a performance evaluation shall prepare a performance evaluation result report in writing or as an electronic document, including the following, pursuant to Article 40 (3) of the Act:
1. 관리주체가 설정한 시설물 성능목표 및 관리지표
1. The performance targets and management indicators of the facility set by the management entity;
2. 시설물의 안전성 평가에 관한 사항
2. Matters concerning the safety evaluation of the facility;
3. 시설물의 내구성 평가에 관한 사항
3. Matters concerning the durability evaluation of the facility;
4. 시설물의 사용성 평가에 관한 사항
4. Matters concerning the serviceability evaluation of the facility;
5. 시설물의 종합성능에 관한 사항
5. Matters concerning the overall performance of the facility;
6. 시설물의 성능목표를 고려한 유지관리에 대한 제안
6. Proposals on maintenance in consideration of the performance targets of the facility;
7. 그 밖에 시설물의 성능평가에 관한 것으로서 국토교통부장관이 정하여 고시하는 사항
7. Other matters concerning performance evaluation of the facility that are determined and publicly notified by the Minister of Land, Infrastructure and Transport.
⑦ 국토교통부장관은 법 제40조제5항에 따라 준용되는 법 제17조제3항에 따라 성능평가 결과보고서와 그 작성의 기초가 되는 자료를 부실하게 작성한 것으로 판단하는 때에는 부실의 정도 등을 고려하여 매우 불량, 불량 및 미흡으로 구분하여 판단한다. <신설 2020.1.7>
(7) When the Minister of Land, Infrastructure and Transport determines, under Article 17 (3) of the Act, which applies mutatis mutandis under Article 40 (5) of the Act, that a performance evaluation result report and the data forming the basis of its preparation were prepared inadequately, the Minister shall classify it as very poor, poor, or inadequate in consideration of the degree of inadequacy.
⑧ 법 제40조제6항에서 "대통령령으로 정하는 기준"이란 별표 14와 같다. <개정 2020.1.7>
(8) The term "standards prescribed by Presidential Decree" in Article 40 (6) of the Act is as set out in Table 14.
⑨ 제1항부터 제8항까지에서 규정한 사항 외에 성능평가의 실시에 필요한 세부사항은 국토교통부장관이 정하여 고시한다. <개정 2020.1.7>
(9) In addition to the matters prescribed in paragraphs (1) through (8), detailed matters necessary for conducting performance evaluations shall be determined and publicly notified by the Minister of Land, Infrastructure and Transport.
